What Can Lawyers Do To Help Chris Bell? Chris Bell called a spade a spade when he wrote that the Republican legislature and the incumbent governor of Texas stole from the state’s public utilities safety net $427,000,000 of the System Benefit Fund for assistance to the poor in paying their electric bills. The 65 cent per megawatt hour charge is still assessed against every purchaser of electricity in Texas. The charge was to be used to assist the neediest of the state’s citizens, the poor and elderly, pay for electricity when they could not afford it. When the System Benefit Fund was being used as it was intended some 400,000 Texas households received assistance. Then in September 2005 Perry and his henchmen diverted $427 million dollars from the dedicated fund to their general purposes in the budget. Last Year in Texas rates for electricity have skyrocketed under Perry’s regime by 24 to 45 % and 30% of all customers were disconnected. Collecting money for one purpose—to assist the poor in paying their electricity bills---and not using it for that purpose but using it for whatever they feel like spending it on is fraud.
